      <P>The Commission on Global Governance has released its =
recommendations in=20
      preparation for a World Conference on Global Governance, scheduled =
for=20
      1998, at which official world governance treaties are expected to =
be=20
      adopted for implementation by the year 2000. Among those =
recommendations=20
      are specific proposals to expand the authority of the United =
Nations to=20
      provide:=20
      <UL>
        <LI>Global taxation;=20
        <LI>A standing UN army;=20
        <LI>An Economic Security Council;=20
        <LI>UN authority over the global commons;=20
        <LI>An end to the veto power of permanent members of the =
Security=20
        Council;=20
        <LI>A new parliamentary body of "<EM>civil society</EM>" =
representatives=20
        (NGOs);=20
        <LI>A new "<EM>Petitions Council</EM>";=20
        <LI>A new Court of Criminal Justice; <FONT =
color=3Dred>(Accomplished in=20
        July, 1998 in Rome)</FONT>=20
        <LI>Binding verdicts of the International Court of Justice;=20

      <P>These proposals reflect the work of dozens of different =
agencies and=20
      commissions over several years, but are now being advanced by the=20
      Commission on Global Governance in its report entitled <EM>Our =
Global=20
      Neighborhood</EM> (Oxford University Press, 1995, ISBN =
0-19-827998-3,=20
      410pp).=20
      <P>The Commission consists of 28 individuals, carefully selected =
because=20
      of their prominence, influence, and their ability to effect the=20
      implementation of the recommendations. The Commission is not an =
official=20
      body of the United Nations. It was, however, endorsed by the UN =
Secretary=20
      General and funded through two trust funds of the United Nations=20
      Development Program (UNDP), nine national governments, and several =

      foundations, including the MacArthur Foundation, the Ford =
Foundation, and=20
      the Carnegie Corporation.=20
      <P>The Commission believes that world events, since the creation =
of the=20
      United Nations in 1945, combined with advances in technology, the=20
      information revolution, and the now-global awareness of impending=20
      environmental catastrophe, create a climate in which the people of =
the=20
      world will recognize the need for, and the benefits of, global =
governance.=20
      Global governance, according to the report, "<EM>does not imply =
world=20
      government or world federalism</EM>." Although the difference =
between=20
      "world government" and "global governance" has been compared to =
the=20
      difference between "rape" and "date-rape," the system of =
governance=20
      described in the report is a new system. There is no historic =
model for=20
      the system here proposed, nor is there any method by which the =
governed=20
      may decide whether or not they wish to be governed by such a =
system.=20
      Global governance is a procedure toward defined objectives that =
employs a=20
      variety of methods, none of which give the governed an opportunity =
to vote=20
      "yes" or "no" for the outcome. Decisions taken by administrative =
bodies,=20
      or by bodies of appointed delegates, or by "accredited" civil =
society=20
      organizations, are already implementing many of the =
recommendations just=20
      published by the Commission.=20
      <P><EM><STRONG>The Foundation for Global Governance</EM></STRONG>=20
      <P>The foundation for global governance is the belief that the =
world is=20
      now ready to accept a "<EM>global civic ethic</EM>" based on =
"<EM>a set of=20
      core values that can unite people of all cultural, political, =
religious,=20
      or philosophical backgrounds</EM>." This belief is reinforced by =
another=20
      belief: "<EM>that governance should be underpinned by democracy at =
all=20
      levels and ultimately by the rule of enforceable law</EM>."=20
      <P>The report says: "<EM>We believe that all humanity could uphold =
the=20
      core values of respect for life, liberty, justice and equity, =
mutual=20
      respect, caring, and integrity</EM>." In the fine print, these =
lofty=20
      values lose much of their appeal. Respect for life, for example, =
is not=20
      limited to human life. "Respect for life" actually means equal =
respect for=20
      <EM>all</EM> life. The <EM>Global Biodiversity Assessment</EM> =
(Section=20
      9), prepared under the auspices of the United Nations Environment=20
      Programme, describes in great detail the biocentric view that =
"<EM>humans=20
      are one strand in nature's web</EM>," consistent with the =
biocentric view=20
      that all life has equal intrinsic value. Some segments of humanity =
may=20
      balk at extending to trees, bugs, and grizzly bears the same =
respect for=20
      life that is extended to human beings.=20
      <P>"<EM>Next to life, liberty is what people value most</EM>," the =
report=20
      says. It also says: "<EM>The impulse to possess turf is a powerful =
one for=20
      all species; yet it is one that people must overcome</EM>." It =
also says:=20
      "<EM>global rules of custom constrain the freedom of sovereign=20
      states</EM>," and "<EM>sensitivity over the relationship between=20
      international responsibility and national sovereignty [is a] =
considerable=20
      obstacle to the leadership at <IMG align=3Dleft=20
      src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/img.gif" =
width=3D301=20
      height=3D112>the international level</EM>," and "<EM>Although =
states are=20
      sovereign, they are not free individually to do whatever they =
want</EM>."=20
      Maurice Strong, a member of the Commission, and a likely candidate =
for the=20
      position of Secretary General, said in an essay entitled =
<EM>Stockholm to=20
      Rio: A Journey Down a Generation:</EM> "<EM>It is simply not =
feasible for=20
      sovereignty to be exercised unilaterally by individual =
nation-states,=20
      however powerful. It is a principle which will yield only slowly =
and=20
      reluctantly to the imperatives of global environmental =
cooperation</EM>."=20
      <P>The core value of "<EM>justice and equity</EM>" is the basis =
for=20
      sweeping changes in the UN as proposed by the Commission. The =
Commission=20
      has determined that: "<EM>Although people are born into widely =
unequal=20
      economic and social circumstances, great disparities in their =
conditions=20
      or life chances are an affront to the human sense of justice. A =
broader=20
      commitment to equity and justice is basic to more purposeful =
action to=20
      reduce disparities and bring about a more balanced distribution of =

      opportunities around the world. A commitment to equity everywhere =
is the=20
      only secure foundation for a more humane world order.... Equity =
needs to=20
      be respected as well in relationships between the present and =
future=20
      generations. The principle of intergenerational equity underlies =
the=20
      strategy of sustainable development</EM>."=20
      <P>"<EM>Mutual respect</EM>" is broadly defined as "tolerance." =
"<EM>Some=20
      assertions of particular identities may in part be a reaction =
against=20
      globalization and homogenization, as well as modernization and=20
      secularization. Whatever the causes, their common stamp is=20
      intolerance</EM>." Individual achievement and personal =
responsibility are=20
      counter to the value of "<EM>mutual respect</EM>" as suggested in =
the UN's=20
      World Core Curriculum, authored by Robert Muller, Chancellor of =
the UN=20
      University and former Deputy Secretary General to three UN =
Secretaries=20
      General. The <EM>Robert Muller School World Core Curriculum =
Manual</EM>=20
      (November, 1986) says: "<EM>The idea for the school grew out of a =
desire=20
      to provide experiences which would enable the students to become =
true=20
      planetary citizens through a global approach to education.</EM>" =
The first=20
      principle of the curriculum is to: "<EM>Promote growth of the =
group idea,=20
      so that group good, group understanding, group interrelations and =
group=20
      goodwill replace all limited, self-centered objectives leading to =
group=20
      consciousness</EM>."=20
      <P>The value of "<EM>caring</EM>" is institutionalized in the =
Commission's=20
      proposals: "<EM>The task for governance is to encourage a sense of =
caring,=20
      through policies and mechanisms that facilitate co-operation to =
help those=20
      less privileged or needing comfort and support in the world</EM>." =

      "<EM>Integrity</EM>" is defined to be the adoption and practice of =
these=20
      core values and the absence of corruption. As the world adopts =
these core=20
      values, the Commission believes a "global ethic" will emerge. =
Global=20
      governance will "<EM>Embody this ethic in the evolving system of=20
      international norms, adapting, where necessary, existing norms of=20
      sovereignty and self-determination to changing realities.</EM>" =
The=20
      effectiveness of this global ethic "<EM>will depend upon the =
ability of=20
      people and governments to transcend narrow self-interests and =
agree that=20
      the interests of humanity as a whole will be best served by =
acceptance of=20
      a set of common rights and responsibilities. Without the =
objectives and=20
      limits that a global ethic would provide, however, global civil =
society=20
      could become unfocused and even unruly. That could make effective =
global=20
      governance difficult</EM>."=20
      <P>Among the "rights" such a global ethic would bestow upon all =
people=20
      are:=20
      <P>A secure life;=20
      <P>An opportunity to earn a fair living;=20
      <P>Equal access to the global commons.=20
      <P>The right to "<EM>a secure life</EM>" means much more than =
freedom from=20
      the threat of war. "<EM>Human security includes safety from =
chronic=20
      threats such as hunger, disease, and repression, as well as =
protection=20
      from sudden and harmful disruptions in the patterns of daily life. =
The=20
      Commission believes that the security of people must be regarded =
as a goal=20
      as important as the security of states.</EM>" Herein lies a =
significant=20
      expansion of the responsibilities of the United Nations. Until =
now, the=20
      UN's responsibility was limited to its member states. The =
Commission's=20
      proposals will give to the UN responsibility for the security of=20
      individuals within the boundaries of member states. This shift is=20
      extremely significant as we shall see when we examine proposed =
changes in=20
      the structure and authority of UN organizations.=20
      <P>The right to a secure life also means the right to live on a =
secure=20
      planet. "<EM>Human activity...combined with unprecedented =
increases in=20
      human numbers...are impinging on the planet's basic life support =
systems.=20
      Action must be taken now to control the human activities that =
produce=20
      these risks.... In confronting these risks, the only acceptable =
path is to=20
      apply the `precautionary principle'</EM>." Clearly, the Commission =
sees=20
      the UN as the global authority for protecting the environment.=20
      <P>The right to earn a "<EM>fair living</EM>" carries with it =
far-reaching=20
      implications. The Commission discusses at length what is "fair" =
and what=20
      is not. It is not fair, for example, for the developed countries, =
which=20
      contain 20 percent of the population, to use 80 percent of the =
natural=20
      resources. It is not fair for the permanent members of the =
Security=20
      Council to have the right of veto. In general, it is not fair for =
one=20
      segment of the population to be rich while another segment of the=20
      population is poor. "<EM>Unfair in themselves, poverty and extreme =

      disparities of income fuel both guilt and envy <IMG align=3Dleft=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/funation.gif"=20
      width=3D300 height=3D250>when made more visible by global =
television. They=20
      demand, and in recent decades have begun to receive, a new =
standard of=20
      global governance.</EM>" The right to earn a fair living implies =
that=20
      there must be some kind of a job available from which people may =
earn=20
      their living. Under the auspices of a new Economic Security =
Council, which=20
      we will discuss later, the Commission would give the UN =
responsibility for=20
      seeing that all people would have "<EM>an opportunity to earn a =
fair=20
      living</EM>."=20
      <P>The Commission sees pollution of the global atmosphere and the=20
      depletion of ocean fisheries as inadequacies of global governance. =
"<EM>We=20
      propose, therefore, that the Trusteeship Council...be given the =
mandate of=20
      exercising trusteeship over the global commons. Its functions =
would=20
      include the administration of environmental treaties.... It would =
refer=20
      any economic or security issues arising from these matters to the =
Economic=20
      Security Council or the Security Council</EM>." Trusteeship over =
the=20
      global commons provides the basis to levy user fees, taxes and =
royalties=20
      for permits to use the global commons. Global commons are defined =
to be:=20
      "<EM>the atmosphere, outer space, the oceans, and the related =
environment=20
      and life-support systems that contribute to the support of human=20
      life</EM>." This broad definition of the global commons would give =
the UN=20
      authority to deal with environmental matters inside the borders of =

      sovereign states, and on privately owned property.=20
      <P>The foundation of global governance is a set of core values, a =
belief=20
      system, which contains ideas that are foreign to the American =
experience,=20
      and ignores other values and ideas that are precious to the =
American=20
      experience. The values and ideas articulated in the Commission's =
report=20
      are not new. They have been tried, under different names, in other =

      societies. Often, the consequences have been devastating. These =
values,=20
      under new names, have been emerging in UN documents since the late =
1980s,=20
      and have dominated international conferences, agreements, and =
treaties=20
      since 1992. This set of core values underlies <EM>Agenda 21</EM> =
adopted=20
      in Rio de Janeiro. Virtually every international treaty and =
agreement=20
      introduced during this decade reflects this set of core values. =
The=20
      Commission's recommendations to achieve global governance seek to =
enforce=20
      these values through the programs authorized and implemented by a =
global=20
      bureaucracy growing from a revitalized and restructured United =
Nations=20
      system.=20
      <P><EM><STRONG>The Structure of Global Governance</STRONG></EM>=20
      <P>The UN Security Council is the supreme organ of the United =
Nations=20
      system. Originally, the Council had eleven members, of which =
China,=20
      France, Russia, the United Kingdom, and the United States were =
permanent=20
      members with veto power. The other six positions rotated in two- =
year=20
      terms among the remaining members of the UN General Assembly. The =
Council=20
      now has 15 members which would be increased to 23. The proposal =
stops=20
      short of recommending the elimination of permanent status, but =
does=20
      recommend that the remaining members serve as "standing members" =
until a=20
      full review of member status can be conducted, including the =
permanent=20
      members, "<EM>in the first decade of the next century</EM>." A =
phase-out=20
      of the veto power of permanent members is recommended.=20
      <P>Perhaps more important are the proposed new principles under =
which the=20
      Security Council may take action. "<EM>We propose that the =
following be=20
      used as norms for security policies in the new era:</EM>=20
      <P><EM>All people, no less than all states, have a right to a =
secure=20
      existence;</EM>=20
      <P><EM>Global security policy should be to prevent conflict and =
war and to=20
      maintain the integrity of the planet's life-support systems by =
eliminating=20
      the economic, social, environmental, political and military =
conditions=20
      that generate threats to the security of people and the =
planet;</EM>=20
      <P><EM>Military force is not a legitimate political instrument =
except in=20
      self-defense or under UN auspices.</EM>=20
      <P><EM>The production and trade in arms should be controlled by =
the=20
      international community</EM>."=20
      <P>The Commission believes and recommends "<EM>that it is =
necessary to=20
      assert...the rights and interests of the international community =
in=20
      situations within individual states in which the security of =
people is=20
      violated extensively. We believe a global consensus exists today =
for a UN=20
      response on humanitarian grounds in cases of gross abuse of the =
security=20
      of people</EM>."=20
      <P>Subtle, carefully crafted language significantly expands the =
mission=20
      and authority of the UN Security Council to intervene in the =
affairs of=20
      sovereign states when it determines that the security of =
individuals is in=20
      jeopardy. <IMG align=3Dright=20
      src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fchina.gif" =
width=3D204=20
      height=3D136>Security of individuals, under the set of core values =
and the=20
      new global ethic, includes an opportunity to earn a fair living, =
and equal=20
      access to the global commons. This expanded authority includes =
military=20
      intervention - as a last resort.=20
      <P>The Security Council would also be empowered to raise a =
standing army.=20
      Article 43 of the UN Charter authorizes such a force, but has =
never been=20
      activated. The Commission says: "<EM>It is high time that this =
idea - a=20
      United Nations Volunteer Force - was made a reality</EM>." Such a =
force=20
      would be under the exclusive authority of the UN Security Council =
and=20
      under the day-to-day command of the UN Secretary General. It would =

      maintain its own support and mobilization capabilities and be =
available=20
      for "rapid deployment" anywhere in the world. The Commission =
envisions a=20
      small, highly trained, well equipped force of 10,000 troops for =
immediate=20
      intervention while more conventional "peace keeping" forces are =
assembled=20
      from member nations.=20
      <P><STRONG><EM>A Restructured Trusteeship Council</EM></STRONG>=20
      <P>The Trusteeship Council is an original principal organ of the =
United=20
      Nations system. Created to oversee nations in transition from =
colonies to=20
      independence, its work was concluded in 1994 when the last of the=20
      colonies, Palau in the South Pacific, gained its independence. The =

      Commission has proposed amending Chapters 12 and 13 of the UN =
Charter to=20
      give the Trusteeship Council authority over the global commons, =
and to=20
      reconstitute the Council with a fixed number of members including=20
      qualified members from "civil society." This proposal is another =
extremely=20
      significant step in the creation of a new form of governance. A=20
      "<EM>qualified member from civil society</EM>" means a =
representative from=20
      an <IMG align=3Dright=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fmexico.gif"=20
      width=3D204 height=3D146>accredited NGO (non-government =
organization). The=20
      status of NGOs is elevated even further in the Commission's=20
      recommendations which we will be see later. Here, however, for the =
first=20
      time, unelected, self-appointed, environmental activists are given =
a=20
      position of governmental authority on the governing board of the =
agency=20
      which controls the use of atmosphere, outer space, the oceans, =
and, for=20
      all practical purposes, biodiversity. This invitation for "civil =
society"=20
      to participate in global governance is described as expanding =
democracy.=20
      <P>The work assigned to the Trusteeship Council is now the =
responsibility=20
      of the Economic and Social Council (ECOSOC), which was an original =

      principal organ of the UN system. The Commission proposes that =
ECOSOC be=20
      retired and all the agencies and programs under its purview be =
shifted to=20
      the Trusteeship Council. The United Nations Environment Programme, =
along=20
      with all the environmental treaties under its jurisdiction, would=20
      ultimately be governed by a special body of environmental =
activists,=20
      chosen only from accredited NGOs appointed by delegates to the =
General=20
      Assembly who are themselves appointed by the President. The =
Commission=20
      says: "<EM>The most important step to be taken is the conceptual =
one that=20
      the time has come to acknowledge that the security of the planet =
is a=20
      universal need to which the UN system must cater</EM>." The =
environmental=20
      work program of the entire UN system will be authorized and =
coordinated by=20
      this body. Enforcement will come from an upgraded Security =
Council, and=20
      from the new Economic Security Council.=20
      <P><STRONG><EM>The New Economic Security Council</EM></STRONG>=20
      <P>Described as an "<EM>Apex Body</EM>," the Economic Security =
Council=20
      (ESC) is proposed to have "<EM>the standing in relation to =
international=20
      economic matters that the Security Council has in peace and =
security=20
      matters</EM>." The new ESC would be <IMG align=3Dleft=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fnorway.gif"=20
      width=3D204 height=3D146>a deliberative, policy body rather than =
an executive=20
      agency. It would work by consensus without veto power by any =
member.=20
      "<EM>The time is now ripe - indeed, overdue - to create a global =
forum=20
      that can provide leadership in economic, social and environmental=20
      fields</EM>." According to the Commission, the new ESC would: <BR=20
      wp=3D"br1"><BR wp=3D"br2">
      <P>Continuously assess the overall state of the world economy;=20
      <P>Provide a long-term strategic policy framework to promote =
sustainable=20
      development;=20
      <P>Secure consistency between the policy goals of the =
international=20
      economic institutions (World Bank, International Monetary Fund, =
World=20
      Trade Organization, Global Environment Facility, and others);=20
      <P>Study proposals for financing public goods by international =
revenue=20
      raising. (Public goods are defined to be: "<EM>The rules and sense =
of=20
      order that must underpin any stable and prosperous system.... It =
is in=20
      their nature not to be provided by markets or by individual =
governments=20
      acting in isolation</EM>").=20
      <P>The agenda to be addressed by the ESC includes: "<EM>long-term =
threats=20
      to security in its widest sense, such as shared ecological crises, =

      economic instability, rising unemployment...mass poverty...and =
with the=20
      promotion of sustainable development</EM>."=20
      <P>The Commission recommends that the ESC have no more than 23 =
members,=20
      that it be headed by a new Deputy <IMG align=3Dright=20
      src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fitaly.gif" =
width=3D204=20
      height=3D136>Secretary-General for Economic Co-operation and =
Development,=20
      and that the gross domestic product (GDP) of all member nations be =

      measured by and based upon "<EM>Purchase Power Parity (PPP)</EM>." =
PPP is=20
      an accounting device, which (according to a chart on page 163 of =
the=20
      report) transforms the 1991 U.S. trade deficit of $28 billion into =
a trade=20
      surplus of $164 billion.=20
      <P>Both the World Trade Organization (WTO) and the International =
Labor=20
      Organization (ILO) would be brought under the authority of the new =
ESC.=20
      The Commission believes: "<EM>for economic growth to raise the =
living=20
      standards of the poor and be environmentally sustainable, trade =
has to be=20
      open and based on stable, multilaterally agreed rules</EM>." The =
ESC would=20
      be given authority over telecommunications and multimedia. Since =
the=20
      atmosphere and outer space are "global commons" assigned to the=20
      Trusteeship Council, businesses that use the air waves and =
satellites=20
      would be subject to the policies of the ESC. The Commission says: =
"<EM>=20
      Civil society itself should try to provide a measure of global =
public=20
      service broadcasting not linked to commercial interests. The =
highest=20
      priority should be given to examining how an appropriate system of =
global=20
      governance can be created for overseeing the `global information =
society'=20
      through a common regulatory approach</EM>." The Commission calls =
on the=20
      WTO to give poor countries preferential treatment in license =
allocations=20
      and to create rules to counter the influence of "national =
monopolies."=20
      <P>Without this high-level ESC, the Commission fears that "<EM>the =
global=20
      neighborhood could become a battleground of contending economic =
forces,=20
      and the capacity of humanity to develop a common approach will be=20
      jeopardized</EM>." The ESC is expected to address the problem of =
tariffs=20
      and quotas, and, "<EM>A wide range of what used to be considered =
purely as=20
      national concerns: nationally created technical and product <IMG=20
      align=3Dright=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fskorea.gif"=20
      width=3D204 height=3D136>standards, different approaches to social =
provision=20
      and labour markets, competition policy, environmental control, =
investment=20
      incentives, corporate taxation, and different traditions of =
commercial and=20
      intellectual property law, of corporate governance, of government=20
      intervention, and of cultural behavior</EM>."=20
      <P>The ESC is designed to centralize and consolidate policy making =
for not=20
      only world trade, but also for the international monetary system =
and world=20
      development. The Commission says: "<EM>there is a broad consensus =
on many=20
      of the elements: an understanding of the importance of =
environmental=20
      sustainability; financial stability; and a strong social dimension =
to=20
      policy, emphasizing education (especially of women), health, and =
family=20
      planning.</EM>" To deal with third-world debt, the Commission =
recommends=20
      that a system be established "<EM>akin to corporate bankruptcy, =

      migration. They claim a belief in free markets (including labour =

      but use draconian and highly bureaucratic regulations to control=20
      cross-border labour migration</EM>."=20
      <P>Environmental policies are to be under the authority of the =
Trusteeship=20
      Council, but implementation and enforcement of those policies will =
largely=20
      be a function of the ESC. Implementation measures will be =
coordinated=20
      through UN organizations and NGOs. The Commission recognizes that: =

      <P>The Commission recognizes that: "<EM>sustainable development =

      achieved solely through government action or market forces. The =
growing=20
      reliance on non-governmental organizations and institutions as =
partners=20
      with government and business in achieving economic progress is =
leading to=20
      more participatory development. Involving agents of civil society =
leads to=20
      programmes and projects that are more focused on people and more=20
      productive</EM>." To insure greater involvement by "civil =
society," the=20
      Commission has formalized proposals to elevate the status of NGOs. =

      <P><STRONG><EM>The Machinery of Global Governance</EM></STRONG>=20
      <P>The Commission recommends the creation of two new bodies: (1) =
an=20
      Assembly of the People, and (2) a Forum of Civil Society. =
"<EM>What is=20
      generally proposed is the initial setting up of an assembly of=20
      parliamentarians, consisting of representatives elected by =
existing=20
      national legislatures from among their members, and the subsequent =

      establishment of a world assembly through direct election by the=20
      people</EM>." The Forum of Civil Society would consist of "<EM>300 =
- 600=20
      representatives of organizations accredited to the General=20
      Assembly....</EM>" The Forum would meet annually prior to the =
meeting of=20
      the UN General Assembly. "<EM>The considered views of the Forum =
would be a=20
      qualitative change in the underpinnings of global =
governance</EM>."=20
      <P>NGO participation in global governance is an essential feature, =
and is,=20
      in fact, the dimension of governance that is totally new. It is no =
longer=20
      just an idea. It is a demonstrated fact of life which the =
Commission now=20
      seeks to institutionalize through legal status. It is the =
machinery <IMG=20
      align=3Dright=20
      =

and=20
      coordinated from the highest chambers of governance at the United =

      to the most local bodies of governance, including County =

      Councils, and even to local watershed councils.=20
      <P>The idea of NGO participation in global governance is as old as =
the=20
      United Nations. Julius Huxley, who founded the United Nations =
Educational,=20
      Scientific, and Cultural Organization (UNESCO), in 1946, also =
founded the=20
      IUCN in 1948. It was the IUCN that effectively lobbyied the UN =
General=20
      Assembly in 1968 to adopt Resolution #1296, which establishes a =
policy for=20
      "accrediting" certain NGOs. The IUCN is accredited to at least six =

      different UN organizations. Moreover, it is the premier =
international NGO=20
      claiming a membership of 53 international NGOs, 550 national NGOs, =
100=20
      government agencies, and 68 sovereign nations. The current =
president of=20
      the IUCN is Jay Hair, former president of America's largest NGO, =
the=20
      National Wildlife Federation.=20
      <P>The IUCN created the World Wide Fund for Nature (WWF) which in =
turn,=20
      created the World Resources Institute (WRI). These three NGOs =
share=20
      publication credit with the United Nations Environment Programme =
(UNEP) on=20
      virtually every major document on the environment that has been =
released=20
      since 1972. As of 1994, there were 980 accredited NGOs. These NGOs =
are=20
      accredited because of their demonstrated support of issues being =
advanced=20
      by the United Nations. A single NGO is selected to coordinate <IMG =

      align=3Dleft=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fsingapo.gif"=20
      width=3D204 height=3D136>activities within each issue area. In =
addition to the=20
      Internet, NGO coordination information is published by the WRI in =

      publication called <EM>Networking</EM>. Activity of non-accredited =
NGOs is=20
      coordinated through membership in the IUCN. The IUCN Annual Report =
for=20
      1993 claims more than 6000 "experts" in their network who serve as =

      volunteers "<EM>on Technical Advisory Committees, Regional =
Advisory=20
      Councils, Working Groups and Task Forces. Taken together, these =
voluntary=20
      groups are an immense strength of the Union.</EM>"=20
      <P>According to the Commission's report, 28,900 international NGOs =
are=20
      known to exist, and many are directly involved in advancing the =
agenda of=20
      global governance. At UNCED, for example, 7,892 NGOs were =
certified to=20
      participate in the "civil society forum" which preceded the actual =

      conference. Many of the NGOs participated in the preliminary =
Preparatory=20
      Committee Meetings, or "PrepComs," and were prepared and present =
to lobby=20
      the official delegates to the conference. This procedure is =
followed at=20
      virtually every global and regional conference.=20
      <P>This procedure is now being applied to domestic policy. Members =
of the=20
      international NGO community have strong national constituencies, =
and=20
      enormous staff and money capabilities. Global issues, such as the=20
      Biodiversity Treaty, which require national or local action, =
become the=20
      focus of the domestic agenda for national NGOs. The structure and=20
      mechanics of "civil society" participation in global governance is =
further=20
      revealed in a variety of documents originating from the UN =
organizations=20
      and from the IUCN, WWF, and the WRI.=20
      <P>Most often, the term "Public/Private Partnerships" is used to =
describe=20
      and define "civil society" participation. At the lowest, =
"on-the-ground"=20
      level, NGOs are present and prepared to lobby on issues relating =
to a=20
      particular <IMG align=3Dleft=20
      =
src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/fportugl.gif"=20
      width=3D204 height=3D136>watershed, or a particular project under=20
      consideration by a local zoning board. Public/Private Partnerships =

      encourage the creation of "boards" or "councils" which are =
supposed to=20
      represent the interests of all the "stakeholders." In reality, =
these=20
      boards are encouraged because well-prepared NGOs are most often =
able to=20
      dominate the outcome. At the local level, NGOs are frequently =
full-time=20
      professionals, paid by a not-for-profit organization, funded =
through the=20
      coordinated efforts of the Environmental Grantmakers Association =
or the=20
      federal government. The other "stakeholders" in these partnerships =
are=20
      business people who work for a living and simply want to take care =
of the=20
      <IMG align=3Dright=20
      =

      width=3D204 height=3D102>environment, but havetoo little time to =
become=20
      experts on the issues.=20
      <P>Within the broader agenda, NGOs within these local partnerships =

      coordinate with NGOs assigned to multi-county, or regional =
councils. The=20
      NGOs that are assigned to regional councils and partnerships =
coordinate=20
      with the NGOs that set the national agenda. And they are, of =
course, the=20
      same NGOs that are accredited to the UN, or are members of the =
IUCN. Deep=20
      within the 1,100 or more pages of the <EM>Global Biodiversity=20
      Assessment</EM>, there is a discussion of this procedure which, =
ideally,=20
      would culminate with a "Bioregional Council," consisting of=20
      "stakeholders," but dominated by affiliates of "accredited" NGOs, =
that=20
      would have ultimate authority over all local land and resource use =

      decisions.=20
      <P>To further strengthen the participation of NGOs, the Commission =

      recommends the creation of "<EM>a new `Right of Petition' =
available to=20
      international civil society</EM>." The recommendation calls for =
the=20
      creation of a Council for Petitions, "<EM>a high-level panel of =
five to=20
      seven persons, independent of governments and selected in their =
personal=20
      capacity. It would be appointed by the Secretary-General with =
approval of=20
      the General Assembly. It should be a Council that holds in trust =
`the=20
      security of people' and makes recommendations to the =
Secretary-General,=20
      the Security Council, and the General Assembly</EM>." This new =
mechanism=20
      provides a direct route from the local, "on-the-ground" NGO =
affiliates of=20
      national and international NGOs to the highest levels of global=20
      governance. Although this mechanism has not yet been formally =
incorporated=20
      into the UN system, the procedure is being used. For example, the =
Greater=20
      Yellowstone Coalition, a group of affiliated NGOs, recently =
petitioned the=20
      World Heritage Committee of UNESCO asking for intervention in the =
plans of=20
      a private company to mine gold on private land near Yellowstone =
Park. The=20
      UNESCO Committee did intervene, and immediately listed Yellowstone =
as a=20
      "World Heritage Site in Danger." Under the terms of the World =
Heritage=20
      Convention, the United States is required to protect the park, =
even beyond=20
      the borders of the park, and onto private lands if necessary.=20
      <P><STRONG><EM>Enforcing Global Governance</EM></STRONG>=20
      <P><IMG align=3Dright=20
      =

      width=3D204 height=3D143>"<EM>From the outset, the World Court was =

      marginalized...states were free to take it or leave it, in whole =

      part. The rule of law was asserted and, at the same time,=20
      undermined.</EM>" The Commission intends to remedy this situation. =

      Historically, scholars have argued that international law was not =
really=20
      law because there was no international legislature to create it, =
nor an=20
      international police force to enforce it. The Commission's =
recommendations=20
      remedy these problems.=20
      <P>The UN International Law Commission (ILC), a little-known =
subsidiary=20
      organ of the General Assembly created in 1947, is expected to =
expand its=20
      activity to include developing and drafting proposed international =
law.=20
      The IUCN now provides this service through its Environmental Law =
Centre.=20
      <P>The Commission recommends that treaties and agreements be =
written to=20
      include binding adjudication by the World Court, and that all =
nations=20
      "<EM>accept compulsory jurisdiction of the World Court.</EM>" The =
WTO is a=20
      step in this direction. Members agree in advance to accept WTO =
decisions=20
      and not seek bilateral resolution of disputes. "<EM>The very =
essence of=20
      global governance is the capacity of the international community =
to ensure=20
      compliance with the rules of society.</EM>"=20
      <P><STRONG><EM>The New International Criminal Court</EM></STRONG> =
<BR=20

      <P>The ILC has already developed the statutes necessary to <IMG =
align=3Dleft=20

      height=3D136>create a new International Criminal Court. The =
example used to=20
      justify this court is Lybia's refusal to extradite the accused =
terrorists=20
      responsible for the bombing of Pan Am flight 103 over Lockerbie. =
"<EM>An=20
      International Criminal Court should have an independent prosecutor =
or a=20
      panel of prosecutors....Upon receipt of a complaint, the =
prosecutor's=20
      primary responsibility would be to investigate an alleged crime. =
The=20
      prosecutor would, of course, have to act independently and not =
seek or=20
      receive instructions from any government or other source.</EM>"=20
      <P>The Commission recognizes that these recommendations may =
encounter=20
      opposition, and warns that "<EM>internal political processes =
within=20
      nation-states...may become obstacles to adoption of international=20
      standards. In the contemporary world, populist action has the =
potential to=20
      strike down the carefully crafted products of international=20
      deliberation....Yielding to internal political pressure can in a =
moment=20
      destroy the results of a decade of toil.</EM>"=20
      <P>Although not explicitly referenced, this revealing commentary =
likely=20
      points to the outpouring of grassroots opposition to the =
Biodiversity=20
      Treaty when presented to the Senate for ratification in the 103rd=20
      Congress. The treaty - signed by President Clinton, approved by =
the=20
      Democratically-controlled Foreign Relations Committee, championed =
by=20
      virtually all the accredited NGOs, and <IMG align=3Dleft=20
      src=3D"http://www.sovereignty.net/p/gov/gganalysis.htg/img1.gif" =
width=3D301=20
      height=3D206>expected to be approved by a wide margin, - never =
reached the=20
      floor for a vote because of "populist action."=20
      <P>The Commission does not discuss why the activity of accredited =
NGOs and=20
      their affiliates is "expanding democracy" through civil society=20
      participation, while at the same time, activity of non-accredited =
civil=20
      society is "political pressure," and "populist action."=20
      <P><STRONG><EM>Financing Global Governance</EM></STRONG>=20
      <P>The Commission says: "<EM>Past reports recommending globally=20
      redistributive tax principles have received short shrift. The time =
could=20
      be right, however, for a fresh look and a breakthrough in this =
area. The=20
      idea of safeguarding and managing the global commons - =
particularly those=20
      related to the physical environment - is now widely accepted; this =
cannot=20
      happen with a drip-feed approach to financing. And the notion of =
expanding=20
      the role of the United Nations is now accepted in relation to =
military=20
      security</EM>."=20
      <P>Currently, total UN expenditures are slightly more than $11 =
billion=20
      annually, although not all the costs of peacekeeping activities =
are=20
      reflected through the UN system. The cost of implementing Agenda =
21 was=20
      estimated in 1992 to be $600 billion per year. The proposed =
expansion of=20
      the UN system, and the proposals to expand programmatic =
responsibility=20
      suggest staggering costs. Currently, UN costs are paid by member =
nations=20
      in the form of assessments and voluntary contributions. The UN =
Charter=20
      says the costs will be paid by member nations as apportioned by =
the=20
      General Assembly, with no nation paying more than 25 percent. The =
United=20
      States is assessed 25 percent, contributes substantially to the =
volunteer=20
      programs, and ultimately pays more than 30 percent of the =
peacekeeping=20
      costs.=20
      <P>Because the UN has no power to enforce payment of either =
assessments or=20
      voluntary contributions, the Commission says "<EM>the =
industrialized=20
      countries...have severely constrained the exercise of the =
Assembly's=20
      collective authority. A start should be made in establishing =
practical, if=20
      initially small-scale, schemes of global financing to support =
specific UN=20
      operations</EM>." The United States has often withheld payment as =
a means=20
      of influencing UN policy. The Commission is careful to avoid =
giving the UN=20
      direct taxing power. "<EM>We specifically do not propose a taxing =
power=20
      located anywhere in the UN system. User charges, levies, taxes - =
global=20
      revenue-receiving arrangements of whatever kind - have to be =
agreed=20
      globally and implemented by a treaty or convention</EM>." Such an=20
      arrangement appears in the Law of the Seas treaty which authorizes =
a UN=20
      organization to charge application fees and royalties to companies =
wishing=20
      to mine the sea bed - even though the United States has not =
ratified the=20
      treaty.=20
      <P>The Commission's refusal to recommend taxing power for the UN =
while=20
      advancing dozens of global revenue-raising schemes is similar to =
declaring=20
      that "global governance" is not "world government." The Commission =
says=20
      "<EM>It would be appropriate to charge for the use of some common =
global=20
      resources. Another idea would be for corporate taxation of =
multinational=20
      companies</EM>." The favored scheme was first advanced by Nobel =
Prize=20
      winner, James Tobin. He has proposed a tax on international =
monetary=20
      exchange which would yield an estimated $1.5 trillion per year.=20
      "<EM>Charges for use of the global commons have a broad appeal on =
grounds=20
      of conservation and economic efficiency as well as for political =
and=20
      revenue reasons</EM>." The Commission supports a $2 per barrel tax =
on oil,=20
      which automatically escalates to $10 per barrel in 10 years. =
"<EM>A carbon=20
      tax introduced across a large number of countries or a system of =
traded=20
      permits for carbon emissions would yield very large revenues =
indeed</EM>."=20

      <P>Other recommendations for global revenues include:=20
      <P>A surcharge on airline tickets for use of the global commons=20
      <P>A charge on ocean maritime transport=20
      <P>User fees for ocean fishing=20
      <P>Special user fees for activities in Antarctica=20
      <P>Parking fees for geostationary satellites=20
      <P>Charges for user rights of the electromagnetic spectrum=20
      <P>"<EM>We urge the evolution of a consensus to help realize the =
long=20
      discussed and increasingly relevant concept of global =
taxation</EM>."=20
      <P><STRONG><EM>Conclusion</EM></STRONG>=20
      <P>Many of the recommendations contained in this report have =
already been=20
      incorporated into treaties, agreements, and proposals initiated by =
the=20
      international community. Some have already been implemented. The=20
      Commission has called for the General Assembly to schedule a World =

      Conference on Governance in 1998. Preparatory work has already =
begun.=20
      PrepComs will be conducted to develop documents on global =
governance -=20
      similar to the procedure used to develop the documents presented =
at Rio -=20
      which are to be adopted at the 1998 Conference and ratified for=20
      implementation by the year 2000. Only "accredited" NGOs will be =
allowed to=20
      participate in the PrepComs. Only accredited NGOs and their =
affiliates=20
      will participate in the adoption strategy.=20

      <P>The NGO machinery of global governance is at work in America. =
Their=20
      activity includes agitation at the local level, lobbying at the =
national=20
      level, promoting the celebration of the UN's 50th anniversary, =
producing=20
      studies to justify global taxation, and paying for television ads =
that=20
      elevate the image of the UN. The strategy to advance the global =
governance=20
      agenda specifically includes programs to discredit individuals and =

      organizations that generate "internal political pressure" or =
"populist=20
      action" that fails to support the new global ethic. The national =
media has=20
      systematically portrayed dissenting voices as =
right-wing-extremist,=20
      militia-supporting fanatics. Consequently, the vast majority of =
American=20
      citizens have no idea how far the global governance agenda has =
progressed.=20
      This year, 1996, may be the last opportunity the world has to =
avoid, or at=20
      least to influence the shape of global governance. The United =
States is=20
      the only remaining power strong enough to influence the United =
Nations.=20
      Those voices now speaking for all Americans in the United Nations =
are=20
      cheering the forces that would diminish national sovereignty and =
render=20
      individual liberty and property rights relics of the past. If the =
current=20
      voices representing the United States continue to push for global=20
      governance, the world will be committed to a course which will =
truly=20
      transform society more dramatically than the Bolshevik revolution=20
      transformed Russia.=20
      <P>The recommendations of the Commission, if implemented, will =
bring all=20
      the people of the world into a global neighborhood managed by a =
world-wide=20
      bureaucracy, under the direct authority of a minute handful of =
appointed=20
      individuals, and policed by thousands of individuals, paid by =

      NGOs, certified to support a belief system, which to many people - =

      unbeievable and unacceptable.=20
